Welcome to OpenKagi. OpenKagi is built and operated by Ninety2 LLC. These Terms of Service ("Terms") govern your use of the OpenKagi website and services (collectively, the "Service"). By accessing or using OpenKagi, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing and using OpenKagi, you accept and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Service.

2. Description of Service

OpenKagi is a community-driven platform that allows users to create, share, and discover custom search lenses and themes for Kagi Search. OpenKagi is an independent project and is not affiliated with, endorsed by, or sponsored by Kagi, Inc.

3. User Accounts

Account Creation

To use certain features of the Service, you must create an account. You agree to:

• • Provide accurate and complete information
• • Maintain the security of your account credentials
• • Promptly update any information to keep it accurate
• • Accept responsibility for all activities that occur under your account

Account Termination

You may delete your account at any time through your account settings. Upon deletion:

• • Your profile and personal information will be permanently removed
• • All content you've created (lenses and themes) will be deleted
• • Your votes and interactions will be removed from the platform
• • This action is irreversible and data cannot be recovered

We reserve the right to suspend or terminate accounts that violate these Terms or engage in harmful behavior.

4. User Content

Content Ownership

You retain ownership of any content you create and submit to OpenKagi. By submitting content, you grant OpenKagi a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content as part of the Service.

Content Guidelines

You agree not to submit content that:

• • Violates any applicable laws or regulations
• • Infringes on intellectual property rights of others
• • Contains malicious code or harmful content
• • Is offensive, hateful, or discriminatory
• • Is spam or misleading
• • Violates the privacy of others

Content Removal

We reserve the right to remove any content that violates these Terms or is otherwise objectionable, without prior notice.

5. Acceptable Use

You agree to use OpenKagi only for lawful purposes and in accordance with these Terms. You agree not to:

• • Interfere with or disrupt the Service or its servers

Your use of OpenKagi is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

Data Deletion Rights

You have the right to delete your account and all associated data at any time. This self-service option is available in your account settings and will permanently remove all your personal information and content from our systems.

7. Third-Party Services

OpenKagi integrates with the following third-party services:

• Supabase: For authentication and data storage
• Netlify: For website hosting
• Fathom Analytics: For privacy-focused analytics
• Cloudflare Turnstile: For bot protection

Your use of these services is subject to their respective terms and privacy policies. OpenKagi is not responsible for the practices of these third-party services.

8. Intellectual Property

The OpenKagi Service, excluding user-generated content, including its original content, features, and functionality, is owned by Ninety2 LLC and is protected by international copyright, trademark, and other intellectual property laws.

"Kagi" is a trademark of Kagi, Inc. OpenKagi is not affiliated with Kagi, Inc. All other trademarks, service marks, and trade names are the property of their respective owners.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• • The Service will be uninterrupted or error-free
• • The Service will be free of viruses or harmful components
• • The results obtained from using the Service will be accurate or reliable

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NINETY2 LLC AND OPENKAGI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify and hold harmless Ninety2 LLC, OpenKagi, and their operators from any claims, damages, losses, liabilities, costs, and expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify users by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes indicates your acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.
